Terms and Conditions

1. This offer is brought to you by The Hongkong and Shanghai Banking Corporation Limited, India (‘HSBC‘) and any participation in this regard is voluntary.
2. This offer is open only to those select account holders and their delegates (individual cardholders) to whom it is addressed. This offer is not open to all customers of HSBC.
3. Under this offer, participants are required to spend the minimum amount quoted during the promotion period on their HSBC Business Debit Card by using it to pay for purchases at merchant establishments or make minimum ATM Transactions quoted during the promotion period on their HSBC Business Debit Card, in order to be eligible for the gift mentioned on the communication.
4. This offer is open between 1 Jul 2010 and 31 Aug 2010 (both days inclusive) (“promotion period”). This offer may be extended beyond the specified duration without prior notice at the sole discretion of HSBC.
5. This offer is available only for HSBC Business Debit Cardholders and is not applicable for ATM cardholders or other cardholders of HSBC.
6. Gifts will be awarded to the individual cardholders who qualify.
7. Each delegate is eligible to win only one gift under this offer, regardless of the actual amount spent or number of transactions during the promotion period.
8. The choice of gift will be at the sole discretion of HSBC and is subject to change without any prior notice.
9. If the bank account is closed at any time during the promotion period, the delegate will be deemed ineligible for the gift.
10. The gift under this offer shall be delivered / couriered at the mailing address available on record with the bank as at the time of dispatch, within 45 days from the end of the promotion period. The gifts shall be delivered / couriered at addresses in India only
11. All decisions in respect of the offer, including number of gifts, will be at the sole discretion of HSBC and the same will be final and binding on a non-contestable basis. All participants waive any and all rights of claim with regard to the offer against HSBC.
12. HSBC makes no representations or warranties as to the quality, suitability or merchantability of any gift.
13. HSBC shall not be liable for any direct or indirect loss or damage whatsoever that may be suffered, or for any personal injury that may be suffered, as a result of participating in the offer or by using any of the gifts.
14. HSBC reserves the right to withdraw and/or alter any/all of the terms and conditions of this offer at any time without prior notice.
15. All gifts are non-transferable and cannot be exchanged for cash. No cash claim can be made in lieu of gifts.
16. Any dispute arising out of or in connection with this offer shall be subject to the exclusive jurisdiction of the courts in Mumbai only. The existence of a dispute, if any, shall not constitute a claim against HSBC.
17. Tax liability, if any, will be borne by the participants themselves.
18. By participating in this offer, the participants accept the Terms and Conditions of entry as specified above in total.
