• This promotion is brought to you by The Hongkong and Shanghai Banking Corporation Limited, India (HSBC) and is open to select HSBC Gold & Platinum Visa Credit Cardholders (hereinafter referred to as “Cardholder”) to whom this mailer is addressed. Cardholders are required to use their HSBC Gold or Platinum Visa  Credit Card for making payments to avail of the promotion.
• Any participation in this promotion is voluntary.
• The promotion for HSBC Gold or Platinum Visa Credit Cardholders are as follows -

  a) Make a package booking and get a cashback of Rs. 3000 per booking.
  b) Rs. 1000 off on hotel bookings (minimum purchase value of Rs. 4000 for hotels).
  c) Rs. 750 off* for International Flights. (No discount on SAARC sectors)
  d) Rs. 200 cashback on all domestic flights.
  e) Additionally HSBC Gold or Platinum Visa Credit Cardholders gets a complimentary Rs. 350 e-Voucher on travel booking.

• Cashback would be credited within 7 working days from the date of transaction.
• Promotions are valid from 18th December to 15th February 2010, both days inclusive.
• The Cardholder should announce his/her intent to avail the promotion before the bill is prepared.
• Promotion cannot be clubbed with any other promotional schemes, promotions or sale already running at the respective outlets/stores.
• The promotion is valid on direct booking on travelocity.co.in or booking done through their call center (0124-2398222 or 18001801222 (Toll free) and is subject to availability.
• The listed promotions cannot be exchanged for cash.
• HSBC is not making any promotion and does not make any warranties or representations about the quality, merchantability, suitability or availability of the products included in this promotion or about the participating establishments. HSBC is not liable for any defect or deficiency in the product obtained under this promotion and all disputes in this regard should be taken up with Travelocity.
• Cardholders accept to read, understand, agree and accept the terms & conditions of the Travelocity India before availing the Promotion.
• Upon authorization by the Cardholder to participate in the Promotion, HSBC shall not be liable for any loss, injury, defect or deficiency arising out of sharing of any personal data, as required, for availing the promotion on the Travelocity India website by the Cardholder.
• HSBC reserves its absolute right to withdraw or alter any of the terms and conditions of this promotion at any point in time without prior intimation to the Cardholders.
• All decisions in respect of the promotion shall be at the sole discretion of HSBC and the same shall be final, binding and non-contestable.
• All Cardholders waive any and all rights of claim with regard to the promotion against HSBC.
• The promotion is subject to force majeure events.
• Tax liability, if any will be borne by the Cardholder.
• Any disputes arising out of this promotion shall be subject to the exclusive jurisdiction of courts in Mumbai only. The existence of any dispute shall not, by itself, constitute any claim against HSBC.

Travelocity HSBC Visa Promotion: Terms and Conditions (“Terms and Conditions”)

The Travelocity HSBC Visa promotion is valid on Air Tickets, Hotel and Holiday Package bookings done at www.travelocity.co.in or through Travelocity India call centre (collectively as “Travelocity India” or “Travelocity”), between 00:01Hrs December 18, 2009 and 23:59 Hrs February 15, 2010 (“promotion Period”), using a HSBC Visa Gold  or Platinum Card. During the promotion Period and subject to the promotion conditions (“promotion Conditions”) set out here; the terms and conditions of the Travelocity India website (http://www.travelocity.co.in) (the “Travelocity Terms and Conditions”); and the General Terms and Conditions below, eligible Visa cardholder will receive the following two  Promotions on travel bookings:

By proceeding to complete and transact a purchase through Travelocity India, you declare that you have read, understood and freely agree to these promotion Conditions, the Travelocity Terms and Conditions and any other applicable terms of service set out below. You further declare that you have similarly obtained the consent of your traveling companion (where applicable) to the aforementioned.

Promotion 1: Cash Back Promotions
Terms and Conditions governing Cash Back for all Flights, Hotels and Package bookings

This promotion (the “Promotion”) is valid for all Flights, Hotel & Package transactions completed and submitted on www.travelocity.co.in (the “Travelocity Website”) for Domestic or International packages between December 18, 2009 and February 15, 2010. The organizer of this promotion is Travelocity.com Pvt Ltd (“Travelocity” or “Travelocity India”).

• The promotion is applicable on any Flights, Hotels, Package booking for which a Unique Trip ID is assigned for the booking made on the Travelocity India Website using an HSBC VISA Gold or Platinum Credit Card.
• One “Unique Trip ID” is equal to one booking.
• The promotion will not be applicable for bookings made in names other than that of the HSBC Visa Cardholder. One of the passengers traveling or staying in hotel should be the HSBC Visa Cardholder who has made the booking (for the airline ticket or hotel / holiday package respectively)
• The cardholder will be required to make payment as per the price quoted by Travelocity on www.travelocity.co.in (Travelocity website) or at telebooking centre, without considering the cash back benefit, for any travel service purchase. Upon successful transaction, Travelocity will process a credit transaction for the cash back amount on to the customer's card account, within 7 working days following the date of such purchase.
• Cash back will be processed. as per the details herein –

  a)Rs. 200 for Domestic Flights,
  b)Rs. 750 for International Flights bookings,
  c)Rs. 1000 for Hotel bookings and
  d)Rs. 3000 for package bookings

• In the event of cancellation of the booking, the terms and conditions of the airline or hotel (whichever is applicable) will apply. Additionally, bookings for packages are not cancelable or refundable.
• In the event you wish to cancel your booking after the cashback has been credited to your credit card, you agree that Travelocity India shall be entitled to deduct the amount of the cashback from any refund to be made to you. You undertake to remit the amount of the cashback to Travelocity India if no refund is to be made to you.
• For Hotel Bookings, the promotion is applicable on any bookings above Rs. 4000 or more, made on the Travelocity India Website (www.travelocity.co.in).
• For Hotel Bookings, The promotion is only applicable on hotels bearing a “hot deals” label.
• For Hotel Bookings, The promotion is not applicable on hotel chains owned or operated by the Marriott group: Marriott Hotels & Resorts, JW Marriott Hotels & Resorts, Renaissance Hotels & Resorts, Courtyard by Marriott, Residence Inn by Marriott, Fairfield Inn by Marriott, Marriott Conference Centers, TownePlace Suites by Marriott, SpringHill Suites by Marriott, Marriott Vacation Club, The Ritz-Carlton Hotel Company, L.L.C., The Ritz-Carlton Club, Marriott ExecuStay, Marriott Executive Apartments, Grand Residences by Marriott etc. The sole responsibility for verifying if a hotel is owned or operated by the Marriot group lies with you and Travelocity shall in no event be liable for any loss, claims, damages or expenses if the Hotel Bookings is made with hotels that are not applicable under the promotion.

Promotion 2: Introductory e-Voucher promotion:

e-Voucher generation terms and conditions)

• The promotion is Valid only for HSBC VISA card holders having valid HSBC Gold or Platinum Credit Cards.
• The HSBC VISA Card Holder needs to enter his/her Name, mobile, e-mail id and a valid credit card number in the e-voucher generation system. Upon Validation of the same, the e-Voucher generation system will display a 16 digit eVoucher number.
• Each e-voucher code will be for a value of Rs.350, which can be only be used to make a flight, hotel or package booking on travelocity.
• An HSBC VISA cardholder is eligible for only 1(one) eVoucher as per this Promotion.
• Only one e-voucher per transaction may be redeemed per booking. In case of usage of more than one e-voucher in a single transaction, Travelocity reserves the right to cancel your booking without further notification
• The e-Voucher should only be used with an HSBC VISA card at the time of purchase. If an HSBC VISA credit card is not used for the transaction, Travelocity reserves the right to cancel the booking.
• There is no restriction imposed by Travelocity India on the Travel dates except that this promotion is made purely on a first come, first served basis. Travelocity does not make any representations and warranties as to the availability of flights or hotel rooms on any given date.
• Travelocity will deduct the Rs. 350 e-voucher amount from the refund in case of cancellation of the flight, hotel or package booking.
   

eVoucher Usage terms and Conditions

• Travelocity e-vouchers are redeemable only on www.travelocity.co.in (the “Travelocity Website”) for any future flights, hotels and package bookings which are available at the time of your booking subject to the applicable terms and conditions.
• The Travelocity e-vouchers are valid only for one week (7 days) from the date of generation of the e-Voucher and may not be extended. To redeem an e-voucher, HSBC Visa Cardholder has to be an Indian Citizen and aged eighteen (18) years old and above.
• You may redeem the whole e-voucher amount, or the residual value of a previous partially used e-voucher.
• Each e-voucher will come with a code, which has to be entered by you, or your authorized transferee, on the Travelocity Website for redemption. The responsibility for keeping the code confidential lies with you. Travelocity takes no responsibility for any loss, damage and/or suffering which you or your authorized transferee may incur for any misuse or unauthorized usage of the e-vouchers. Please protect the Travelocity e-vouchers number like your Personal Identification Number (PIN) as we will not be responsible for any loss or misuse.
• Each Travelocity e-voucher may only be used more than once, until the total value of the e-voucher has been redeemed. Where the full value of an individual e-voucher has not been redeemed in a single booking transaction, you may use the remainder of the e-voucher in your next transaction. All other expenses become the responsibility of the voucher/s holder/s (and their companions) including but not limited to spending money, transfers, meals (other than those specified), drinks (other than those specified), incidentals, mini-bar, laundry, room service, telephone calls, activities, taxes (including departure taxes), energy surcharges, gratuities, services charges, passports, travel insurance, pre and post accommodation, optional activities or excursions and all other ancillary costs.
• Travelocity will not make any refund for the value (or part thereof) of any Travelocity eVouchers used in bookings which are subsequently cancelled by you.”
• Travelocity India accepts no responsibility for any tax implications that may arise from the usage of vouchers.
• Travelocity India is not responsible for any incorrect or inaccurate information, either caused by the entrant or for any of the equipment or programming associated with or utilised in this incentive scheme (competition), or for any technical or equipment error or malfunction, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications, internet access, network failure, theft or destruction or unauthorised access to or alteration of entries, or due to any reason beyond the reasonable control of Travelocity India.
• TRAVELOCITY INDIA MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO E-VOUCHERS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A E-VOUCHER IS NOT FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, IF ANY, SHALL BE THE REPLACEMENT OF THE NON-FUNCTIONING E-VOUCHER.
• These terms and conditions are to be read in conjunction with any other conditions upon which the Travelocity e-vouchers may be issued.
• All transactions made on the Travelocity website are also governed by the User Agreement, Privacy Policy found on the Travelocity India website, in addition to any applicable terms and conditions of the product and/or service.
• Notwithstanding anything in the foregoing, Travelocity India reserves the right to cancel any transaction or booking made with the use of the e-vouchers without any prior notice to the Customer and the cash back shall be credited to the same credit card as was used for the purpose of making the purchase and will be reflected in the monthly credit card statement.  For the avoidance of doubt, the refund does not include the value of the e-vouchers. Travelocity India shall not be liable for any loss, damages, costs or fees that result from such cancellation.

Travelocity –Visa : General Terms & Conditions

• This Travelocity HSBC Visa promotion is open for participation to all Visa Cardholders, who hold valid and current Visa Platinum or Gold Card issued in India on the terms and conditions set out herein.
• You may not make use of more than one of the above listed promotions per transaction.
• Travel must originate in India.
• Travelocity India is not a supplier of the products or services redeemed under this promotion and will not accept any liability in relation thereto.
• Your use of this Travelocity HSBC Visa promotion is subject to the terms and conditions of the Travelocity India website, which include but not limited to, its User Agreement, Privacy Policy and Security Policy.
• All tickets purchased under the promotion shall be subject to cancellation/date change rules of the respective airlines / hotels and the date change or cancellation penalty as per airlines / hotels rules shall apply. In case of a cancellation, Travelocity shall adjust the cashback amount, applicable on airline cancellation penalty and Rs.300/- as cancellation and handling charges. The refund shall be processed after deduction of the same.
• Cardholders are not bound in any manner to participate in the Travelocity HSBC Visa promotion. Any participation by the Cardholder shall be voluntary and the promotion made by Visa and Travelocity are purely on a best effort basis. The promotion to the cardholders is voluntary without any contractual obligation or compliance thereof, on part of Visa or Travelocity India, since the promotion is purely promotional and subject to availability.
• The Cardholder shall be required to give accurate personal information and Card details online for the tickets purchased on the Travelocity India website. Neither Visa nor Travelocity would not be responsible for any incorrect information given and any loss of damages caused in case of such incorrect information
• Each cashback is processed through a transaction reversal corresponding to the original payment transaction made. The cashback amount will reflect on the card statement of the customer and will not reflect on the flight ticket or the hotel booking confirmation voucher. The Cashback shall be issued to the same HSBC Visa Card used for the purpose of making the payment at the time of purchase, within 7 (seven) working days from the date of purchase.
• Travelocity India and its affiliates apply a credit and risk check (the “Travelocity Risk Check”) on every purchase or transaction made through Travelocity India. Your eligibility for the Travelocity HSBC Visa promotion shall be subject to you being able to satisfy the Travelocity Risk Check. You agree that in the event you or the transaction fails to satisfy the Travelocity Risk check, you shall not be able to avail any of the promotions in this Travelocity HSBC Visa promotion.
• This Travelocity HSBC Visa promotion cannot be combined with any other promotions/discounts/promotions running at Travelocity India. Travel agents are barred from buying tickets / hotels / holiday packages for their customers using their own Visa cards under this promotion. Travelocity India reserves the right to cancel the promotions or cashback on such bookings, if such a case is brought or comes to Travelocity India’s notice. The applicable cancellation or handling fees shall be made and deducted against your account accordingly.
• HSBC Visa Cardholders shall not be entitled to compensation / benefits in any form whatsoever in lieu of the Travelocity HSBC Visa promotion being availed. HSBC or Visa shall not be liable in any manner whatsoever or howsoever for any loss or damage or claims that may arise out of or otherwise howsoever from any refusal to honour the promotion made under the Travelocity HSBC Visa promotion for any reason whatsoever.
• Cardholders must specifically look for the promotion under “Travelocity HSBC Visa Promotion” when making any reservations, bookings or purchases on the Travelocity India website. All Visa Cardholders are advised to check the other applicable terms and conditions of Travelocity India and the Airlines / Hotels before availing the promotion under the Travelocity HSBC Visa Promotion.
• HSBC and Visa shall not be responsible or liable in any manner whatsoever for any deficiency or inadequacy of service rendered by Travelocity India or the Airlines / Hotels for any loss whatsoever of any nature. Travelocity India shall not be responsible or liable in any manner whatsoever for any deficiency or inadequacy of service rendered by the Airlines or Hotels for any loss whatsoever of any nature.
• All terms and conditions of Travelocity HSBC Visa promotion are subject to change without prior notice. HSBC and Travelocity India reserves the absolute right to replace, withdraw and / or alter any of the terms and conditions of this Travelocity HSBC Visa promotion at any time without giving any notice. Information about the promotion is correct at the time of publication. promotion under Travelocity HSBC Visa promotion may be subject to other restrictions by law.
• Travelocity India and their affiliates, including their respective directors, officers, employees and agents, shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct, indirect, special or consequential loss) or for any personal injury suffered or sustained in connection with the Travelocity HSBC Visa promotion except for any liability which cannot be excluded by law. Travelocity India will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this Travelocity HSBC Visa promotion if the deficiency is occasioned by any cause outside the reasonable control of Travelocity India including without limitation technical malfunctions or failures.
• Travelocity India’s decision will be final on any dispute arising out of or in connection with this promotion, by the Cardholders. In the event of any inconsistency between these promotion Conditions, the Travelocity Terms and Conditions and the specific terms of use, they will take effect in the following order of precedence: (1) specific terms of use, (2) promotion Conditions and (3) Travelocity Terms and Conditions.
• The Terms and Conditions of this Travelocity HSBC Visa promotion shall be governed by the laws of Mumbai, India.
• All disputes, if any, arising out of or in connection with this or otherwise relating hereto shall be subject to the exclusive jurisdiction of the courts of Mumbai only, irrespective of whether courts / tribunals in other areas have concurrent or similar jurisdiction.
