• This offer is brought to you by Spencer’s Retail Limited and The Hong Kong and Shanghai Banking Corporation Limited, India (HSBC) and any participation is voluntary. This offer is open only to Resident Indian customers of HSBC India (hereinafter referred to as ‘Applicant’)
• On receipt of the completed HSBC Spencer’s Happy Ties Card application form along with the required documentation the Applicant will be eligible for a gift voucher entitling them to a gift of one free apple / orange fruit beverage under this offer at Spencer’s Retail stores.
• This offer is open from 8th October 2009 till stocks last. This offer may be extended beyond the specified duration without prior notice.
• The gift voucher cannot be exchanged for any other fruit beverage, cash, cheque or any other credit facility.
• The choice of gift will be at the sole discretion of HSBC and Spencer’s and is subject to change without any prior notice.
• The gift voucher under this offer shall be dispatched/ couriered at the mailing address as filled in on the application form, within 15 days. The gift vouchers shall be delivered / couriered at mailing addresses in India only.
• All decisions in respect of the offer, including number of gift vouchers will be at the sole discretion of HSBC and Spencer’s Retail and the same will be final and binding and is non-contestable. All Applicants waive any and all rights of claim with regards to the offer against HSBC.
• HSBC makes no representations or warranties as to the quality, suitability or merchantability of the fruit beverage. Any dispute regarding the quality of the fruit beverage should be referred to Spencer’s Retail Limited and HSBC does not hold any liability in this issue.
• HSBC shall not be liable for any direct or indirect loss or damage whatsoever that may be suffered, or for any personal injury that may be suffered, as a result of participating in the offer or by using any of the gifts.
• HSBC and Spencer’s Retail reserve the right to withdraw and/or alter any of the terms and conditions of this offer at any time without prior notice.
• Tax liability, if any, will be borne by the Applicant.
• Applicants who have already applied for the card before the launch of this offer are not eligible for the gift voucher whether or not they have been issued a card
• Applications for the HSBC Spencer’s Happy Ties Card will be considered complete only after all the required information and relevant documents have been furnished as per HSBC guidelines. HSBC reserves the right to cancel or proclaim any application as incomplete if it does not meet the required norms. No query regarding this shall be entertained.
• Any dispute arising out of or in connection with this offer shall be subject to the exclusive jurisdiction of the courts in Mumbai only. The existence of a dispute, if any, shall not constitute a claim against HSBC.
• Issuance of the Credit Card is at the sole discretion of The Hongkong and Shanghai Banking Corporation Limited, India.
• By participating in this offer, the Applicant accepts all aforementioned the Terms and Conditions of entry in total.
