Terms and Conditions for Flipkart Offer on HSBC Credit Card Instant EMI payment options: During the period 15 February 2023 (00.00 hours) to 19 February 2023 (23:59 hours) (both dates included) (‘Offer Period’), Cardholders on making payment using Instant EMI facility with their valid HSBC Credit Card issued in India only (‘Card’) on www.flipkart.com, Flipkart mAPP (mobile Application) and Flipkart mobile site will be entitled to the below Offer ('Offer'): • 10% Instant Discount up to 1,000 on the purchase of mobile phones and up to 1,500 on purchase of select products from Electronics, Large Appliances, Furniture and Travel Categories only • Minimum Net Transaction Value: 5,000 & above • Offer is valid on HSBC Credit Card Instant EMI transactions only • Offer can be availed up to a maximum discount of 1,500 per card for the Offer Period across multiple transactions each of 5,000 & above • In case a customer makes partial payment through Flipkart gift card, Offer will apply only on the net amount paid using the HSBC Credit Card. Also, this amount should be equal to or more than 5,000 • The Offer is not applicable for Card-on-delivery transactions • Offer will apply over and above Interest Refund benefit which may be available on select products What is Interest Refund benefit? • In Interest Refund benefit, monthly instalment = Total product price / EMI tenure in months • The interest charged by HSBC will be offered in the form of discount by Flipkart, effectively providing Interest Refund benefit • Cardholder will need to pay applicable EMI and interest on total value of the order at the time of payment to the HSBC Credit Card in accordance with the terms applicable to the Credit Card • Please note while HSBC will continue to charge you interest as applicable, this interest charge has been provided to you as discount by Flipkart or concerned Brand as communicated to you at the time of your transaction, effectively giving you the Interest Refund benefit. The Offer is brought to you by The Hongkong and Shanghai Banking Corporation Limited, India (HSBC) and Flipkart Internet Private Limited & Flipkart Advanz Pvt. Ltd. (herein collectively after referred to as ‘Flipkart’) on www.flipkart.com, Flipkart mobile app and Flipkart mobile site (collectively referred to as 'Platform'). This Platform is owned and operated by Flipkart Internet Private Limited and any participation in the said Offer is voluntary. 2. This Offer is applicable to existing and new resident HSBC Credit Cardholders, excluding corporate cardholders (referred to as 'Cardholders'). 3. During the Offer Period, Cardholders can avail the Offer using only Instant EMI payment facility on their valid HSBC Credit Card ('Card') at the time of payment. 4. Cardholders who have not repaid their minimum payment due within 30 days of their payment due date as mentioned on the credit card statement, will not be eligible for the Offer. 5. Add-on Cardholders will be separately and additionally eligible for the Offer. 6. Transactions where payment (partial or full) is made using any other mode of payment (other bank cards or e-wallet options) will not be eligible for the Offer. Transactions where payments are made with HSBC Credit Cards using any e-wallet will not be eligible for the Offer. 7. No two offers can be combined/availed together available on Flipkart. 8. The Offer is not valid on Non EMI/full swipe HSBC Credit Card transactions, Card/Cash on delivery transactions, Net banking, Debit Cards, Commercial and Corporate Cards issued by HSBC. 9. The Offer discount will be reversed if the Cardholder opts to close the Instant EMI facility and considers pre-payment. 10. Cardholders understand and agree that transactions/payments made through Mobile Credit Card or Tokenised Credit Card facility offered by HSBC will not be valid for availing the Offer. 11. Terms and Conditions of Flipkart would apply with respect to cancellation of orders, refund and replacement. This Offer is subject to the Terms and Conditions of Flipkart as well, and Cardholders are required to refer to, read, understand, accept and agree to be bound by them. 12. All decisions with respect to the Offer, including eligibility of the Offer, shall be at the sole discretion of HSBC and the same shall be final, binding and non-contestable. Other than the specific entitlements available to the Cardholder under the Offer, any other claims with regards to the Offer against HSBC are deemed waived. 13. HSBC does not make any warranties or representation about the quality, merchantability, suitability or availability of the services offered under this Offer. Any dispute regarding these must be addressed in writing, by the Cardholder, directly with Flipkart. 14. HSBC will not be liable for any direct or indirect loss or damage whatsoever that may be suffered, as a result of participating in the Offer. 15. Prior to availing the Offer by making any purchases on Flipkart website and/or mobile application, the Cardholder should refer, read, understand, accept and agree to the user agreement and Terms and Conditions of the said website and mobile application, and proceed only if the Cardholder agrees to abide by the same. The Cardholder might be required to give personal information and other details online. The Cardholder should read and understand the privacy policy of the website and mobile application, prior to providing any such information. Any disclosure of information made by the Cardholder towards availing of or fulfilment of the Offer is at the sole discretion of the Cardholder and HSBC will not be responsible for the same. Merchants may use the personal information shared by the Cardholder for any other purpose (like marketing, etc.) and HSBC shall not be held liable for such usage of personal information. 16. Appropriate discount will be applied only on using valid Cards on purchases made on Flipkart’s e-commerce website the mobile website or mobile application during the Offer Period for the minimum Net Transaction Value as per the Offer. 17. The Net Transaction Value is the total purchase value arrived at before availing discount under this Offer. The Cardholders are advised to check the applicability of the discount before making the payment. 18. HSBC and/or Flipkart reserve the right to cancel any booking in an every of any misuse or abuse of the Offer by anyone or travel agent. HSBC and Flipkart reserves the right to deny the Offer or cancel the booking in case of any fraudulent activity, including creating duplicate accounts, aliasing, placing multiple orders or violating the Terms and Conditions. Upon cancellation, the Offer will not be reinstated. HSBC shall not be liable for any refunds or compensation in case of said cancellations by Flipkart. 19. The discount amount offered will not be settled in cash or cashback to card under any circumstances whatsoever. 20. Product warranty will be regulated by the Terms and Conditions mentioned on the warranty card of respective product/manufacturer. 21. Any defects, deficiency, claims, issues, damages or losses arising with respect to the product/services shall be the sole responsibility and liability of the manufacturer / seller or the service provider and HSBC will not be responsible for the same. 22. Any query regarding the Offer will be entertained during the Offer Period only. 23. In case of complete cancellation of the order by the Cardholder, the transaction will not qualify for the Offer. In case of partial cancellation of the order, the Cardholder shall qualify for the Offer only on the basis of the net amount paid. 24. The Offer is valid in India for adults of a sound mind only. 25. This Offer shall be subjected to all applicable central and/or state laws, rules and regulations. 26. This document is an electronic record in terms of Information Technology Act, 2000, and the rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. 27. As required by applicable law, in the event that the Cardholder makes a purchase of an amount equal to or above 2,00,000, the Cardholder will be required to upload a scanned copy of his/her PAN card on the Platform, within 4 days of making the purchase, failing which, the purchase made by the Cardholder will be cancelled. The requirement to submit the PAN card arises only once and if it has been submitted once by the Cardholder, it need not be submitted again. The order of the Cardholder will be cancelled if there is a discrepancy between the name of the Cardholder and the name on the PAN Card. 28. Pictures of products shown in the communication sent to the customer either through mailers or advertised on the website, are representative only and may not bear a resemblance to the actual products. None of the parties shall under any circumstances be responsible towards the same. 29. HSBC and Flipkart reserve the right to add, alter, modify, change or vary all or any of these Terms and Conditions or to replace, wholly or in part, this Offer with another, whether similar to this Offer or not, or to withdraw it completely at any point in time at its sole discretion. The Offer may/may not be extended as mutually agreed by HSBC and Flipkart. 30. Usage of the Card is governed by applicable Terms and Conditions. The Offer is subject to force majeure events. 33. Tax liability, if any, will have to be borne by the Cardholder. 34. Please note that basis Goods and Services Tax (GST) regulations and notified GST rates, Central GST and State/Union Territory GST or Inter-state GST, will be levied on the discounted price, as applicable. 35. Any disputes arising out of or in connection with the Card shall be subject to the exclusive jurisdiction of courts at Mumbai only. The existence of any dispute shall not, by itself, constitute any claim against HSBC. 36. By participating in the Offer, Cardholders are assumed to have accepted all the aforementioned Terms and Conditions in their totality.
