| HSBC Terms and Conditions of the offer |
- This offer is brought to you by The Hongkong and Shanghai Banking Corporation Limited, India ("HSBC") and any participation in the said offer is voluntary
- The cashback offer is valid for the bookings made from 1st July, 2014 to 31st March, 2015. ("Offer Period")
- The Cardholder needs to voice out/ enter the Deal Code at the time of booking to be eligible for the cashback offer.
- • The offer is valid on usage of HSBC Debit Card and Credit Card ("HSBC Cards"). Offer is not valid on HSBC Corporate credit cards held by resident customers. (herein referred to a ’CARDHOLDER’)
- To be eligible for the offer, cardholder is required to use his/her HSBC Card/s for making the required booking through any of the booking mode as mentioned in the communication. For clarity purpose please note ‘website bookings’ are booking which are made through the official website of Make my Trip i.e. www.makemytrip.com. Mobile App booking refers to transactions that are undertaken on the MakeMyTrip website which has been down loaded as an application to the cardholder’s registered mobile number. Offline transactions refer to transactions which are made at the makemytrip toll free number
- Cardholders are required to visit the merchant specific terms and conditions that may be applicable on bookings made through each of the modes and get acquainted and agree with the same.
- The cashback offer on Domestic Flight can be availed by the Cardholder for a maximum of 2 transactions per calendar month not exceeding 1 (one) transaction per card per day.
- The cashback offer on International Flight can be availed by the Cardholder for a maximum of 2 transactions per calendar month.
- HSBC is not liable for any defect or deficiency in the service availed under this offer and all disputes in this regard shall be the sole responsibility of MMT and should be taken up directly with MMT.
- All Offers are subject to availability
- The offer is subject to force majeure events.
- Tax liability, if any will be borne by the Cardholder.
- HSBC and MakeMyTrip reserve the right, at any time, by giving appropriate notice to the cardholder, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this offer or not, or to extend or withdraw it altogether.
- HSBC is not making any Offer and does not make any warranties or representations about the quality, merchantability, suitability or availability of the products/services included in this Offer or about the participating establishments
- The existence of any dispute shall not, by itself, constitute any claim against HSBC and HSBC shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal injury that may be suffered as a result of availing of these Offers
- The Offer is valid for resident Indian Cardholders only on usage of valid and eligible HSBC Credit Cards and Debit Cards issued in India
- HSBC shall not be liable for any claims or grievances’ solely attributable to MakeMyTrip.

- The cashback offer on Domestic Flight can be availed by the Cardholder for a maximum of 2 transactions per calendar month not exceeding 1 (one) transaction per card per day.
- The cashback offer on International Flight can be availed by the Cardholder for a maximum of 2 transactions per calendar month.
- The Cashback Offer on Domestic Flights shall be subject to the following:

| Flight plus hotel |
- The Cashback offer on Flight plus Hotel (Both Domestic and International) shall be subject to the following:
- The offer can be availed by the Cardholder for a maximum of 1 domestic and 1 international transaction per calendar month per card.
- The Hotel in the package shall be 3 star or above.
- In the event the Hotel is booked for only 1 (one) night then the Hotel shall be located in the same city as the flight destination.
- In case of international bookings, hotel shall be booked for minimum 2 nights.
- In the event the flight duration to the destination in the international package is less than 3 hours then the same shall be considered as a domestic package and the cashback amounts of domestic package shall apply.
- The cashback offer on Flight plus Hotel ( Domestic and International) shall be subject to the following:

| Hotels |
- For Domestic Hotel bookings, the minimum booking amount must be Rs. 3000/- per booking ID to avail the offer.
- For International Hotel bookings, the minimum booking amount must be Rs. 5000/- per booking ID to avail the offer.

| Holidays |
- For Domestic Holiday bookings, the minimum booking amount must be Rs. 30,000/- per booking ID to avail the offer.
- For International Holiday bookings, the minimum booking amount must be Rs. 60,000/- per booking ID to avail the offer.
- The Holiday offers (Domestic and International) are not valid on Flight + Hotel bookings made online on www.makemytrip.com.
- The offer can be availed by the customer for a maximum of 1 transaction per calendar month per card.
- Cashback would be calculated on the non-air component of the holiday package and will not be applicable on airfares and the taxes. All taxes, including but not limited to airport taxes, visa charges and high season surcharge, are payable by the Cardholder and are not a part of the cashback offer.

| Bus |
- For Bus bookings, the offer is not valid on OSRTC, UPSTRC, Luxaria Travels, BSRTC, Punjab Roadways and other state road transport corporation buses.
|
- All the offers are valid on the base fare only except online Hotel offers, which shall be valid on the actual amount charged. The offer is not valid on International Flights booked for infants (0-2 years of age).
- Cashback will be calculated on each Booking ID and not on the number of transactions. For example, if a Cardholder pays in 2 instalments/transactions for 1 Booking ID, the cashback will be calculated on basis of the base amount or card charged amount (whichever is lower) of the Booking ID.
- Offer is not valid on payments made through PayPal account, Cash on Delivery (COD) and EMI Options.
- Within 21 working days following the date of transaction, MakeMyTrip will process a credit transaction for the cashback amount on to the Cardholder's card or bank account held with HSBC .
- For credit card bookings, the cashback amount shall be credited to the same HSBC credit card as was used for the purpose of making the booking, and will reflect in the monthly card statement/s.
- Debit card customers need to provide account information while booking, so that cashback can be credited: IFSC code (Indian Financial System Code), Account Number, Account Type (Saving/Current), Account holder’s name, Bank Name, Branch Name and Bank City.
- For any card related claims, the Cardholder shall approach HSBC and MakeMyTrip shall not entertain any such claims.
- The Cardholder cannot club two offers in the same booking ID. The cashback benefit cannot be combined with any other promotional benefit offered for bookings on MakeMyTrip, except in scenarios where the other benefit is not extended/funded by MakeMyTrip.
- If the Cardholder cancels the travel service purchase after the cashback amount is credited, MakeMyTrip will refund the purchase price after deducting the cashback amount and any other applicable cancellation charges/penalty. For example, if a Cardholder has paid Rs. 10,000 (price quoted by MakeMyTrip) for a travel service and a cashback of Rs. 1,000 has been credited to the Cardholder’s account, the net amount paid by the Cardholder is Rs. 9,000. Thus, if the Cardholder cancels the booking, MakeMyTrip will deduct the cancellation charge/penalty from Rs. 9,000 and the balance xamount will be credited to the Cardholder's card/bank account.
- User Agreement and Privacy Policy at MakeMyTrip website shall apply.
- Prior to using the MMT website, the Cardholder should read and understand the User Agreement and Privacy Policy of the said website and proceed to make purchases only if the Cardholder agrees to abide by the same. The Cardholder shall be required to give personal information and card details online or via IVR, for the tickets purchased on makemytrip.com. The Cardholder should read and understand the Privacy policy for the MMT website, prior to providing such information.
- Cardholders, who are Travel Agents by occupation, are barred from making bookings for their customers and MakeMyTrip reserves the right to deny the offer against such bookings or to cancel such bookings. For such cases, MakeMyTrip shall not refund the booking amount.
- In no event, the entire liability of MakeMyTrip for any dispute arising in connection with this offer shall exceed the cashback amount, a Cardholder is entitled to under the said offer.
- In case of partial cancellation, complete cashback amount be recalled and the customer would not be eligible for the cashback.
- MakeMyTrip and HSBC in no event shall be liable for any incidental, consequential and financial losses in any event whatsoever.
- MakeMyTrip shall not be liable for any claims or grievances’ solely attributable to HSBC.
- MakeMyTrip shall not be liable for any claims arising due to Force Majeure events or situations beyond MakeMyTrip’s reasonable control.
- Any dispute arising out of or in connection with this offer shall be subject to the exclusive jurisdiction of the courts in Mumbai only. The existence of a dispute, if any, shall not constitute any claim against HSBC and MakeMyTrip
- By participating in the offer, the Cardholders shall be deemed to have accepted all the aforementioned Terms and Conditions of HSBC and MMT in totality.
