HSBC Promotional Terms and Conditions Eligibility 1. This promotion is only applicable to designated customers. 2. The promotion period is from 15 February 2016 to 1 April 2016, both dates inclusive (“Promotional Period”). 3. Designated customers must submit the application form to apply for a primary card of UnionPay Dual Currency Diamond Credit Card issued by The Hongkong and Shanghai Banking Corporation Limited in Hong Kong (and its successors and assigns) (the “Bank”) (“Eligible Credit Card”) during the Promotional Period and successfully apply for the Eligible Credit Card (“Eligible Cardholders”) in order to enjoy the first two-year annual fee waiver and the Welcome Gift (as defined in Clause 7 below). All the offers will not be granted for any application received after the Promotional Period. 4. If a designated customer’s application for an Eligible Credit Card is declined by the Bank, the customer will not be eligible for any Welcome Gift. 5. Each Eligible Cardholder is entitled to receive one Welcome Gift only subject to fulfilling the required conditions in these terms and conditions. If an Eligible Cardholder is also entitled to receive any other promotional offer under another concurrent promotion run by the Bank, he/she is only entitled to receive the promotional offer(s) under one promotion at the Bank’s discretion. 6. Employees of the Bank are not eligible for the Welcome Gift. Welcome Gift - Lenovo IdeaPad 11.6” Ultra Thin Laptop (100S) or Panasonic Wearable Camera (HX-A1) or $300 RewardCash 7. Eligible Cardholders are entitled to receive one of the following welcome gifts (each a “Welcome Gift”) upon fulfilling the relevant spending requirement (“Spending Requirement”) specified below: Welcome Gift | Lenovo IdeaPad 11.6” Ultra Thin Laptop (100S) (“Laptop”) Spending Requirement | Redeem at HKD980 upon spending HKD/RMB6,000 or above within first 60 calendar days of the credit card issuance Welcome Gift | Panasonic Wearable Camera (HX-A1) (“Camera”) (Applicable to application via Personal Internet Banking) Spending Requirement | Redeem at HKD880 upon spending HKD/RMB6,000 or above within first 60 calendar days of the credit card issuance Welcome Gift | $300 RewardCash (“RewardCash”) Spending Requirement | Spend HKD/RMB6,000 or above within first 60 calendar days of the credit card issuance i. The Camera is only applicable to application through Personal Internet Banking. ii. The above Spending Requirement amount is the same for HKD and RMB currencies, i.e. the conversion rate of HKD and RMB is 1:1 in the calculation of the Spending Requirement. iii. Each Eligible Cardholder is required to fulfil the applicable Spending Requirement by conducting transaction(s) with the newly approved Eligible Credit Card within the first 60 calendar days from the issue date of Eligible Credit Card. The spending amount is calculated by adding up all spending in HKD and RMB currencies made by the Eligible Credit Card on all types of sales transactions (including but without limitation, cash advances, bill payments, online purchases, mail and telephone orders, insurance payments, Octopus Automatic Add Value service, or posted instalment payments of an instalment plan) (“Eligible Sales Transactions”). Non-sales transactions, including but without limitation, finance charges, cash advance charges, late charges, annual fees, online tax payment or the withdrawal amount of Cash Instalment Plan are not included in the calculation of the Spending Requirement. Unposted, cancelled or refunded transactions and transactions of additional card(s) are also excluded from the calculation of Spending Requirement. iv. A redemption letter for the Laptop or the Camera will be sent to an Eligible Cardholder’s local correspondence address maintained in the Bank’s record at the time of mailing by local mail (overseas address will not be covered) within 2 months upon fulfilment of the relevant Spending Requirement. The Eligible Cardholder must bring the original redemption letter and the Eligible Credit Card as specified in the redemption letter to redeem the Laptop or the Camera at the Bank’s designated redemption centre before the specified redemption deadline. Redemption details, including the redemption method, redemption centre address and redemption deadline, will be set out in the redemption letter. The Eligible Cardholder must use his/her Eligible Credit Card as specified in the redemption letter to settle the amount of HKD980 for redeeming the Laptop/HKD880 for redeeming the Camera at the designated redemption centre. Each Eligible Cardholder who fulfils the relevant Spending Requirement in relation to the Laptop or the Camera will be entitled to receive one redemption letter only. v. RewardCash will be credited to the Eligible Cardholder’s newly approved Eligible Credit Card account within 2 months upon fulfillment of the relevant Spending Requirement. Terms and conditions of the RewardCash Programme apply. 8. Once the Welcome Gift selection is indicated on the credit card application form, it cannot be changed. If an Eligible Cardholder does not indicate the Welcome Gift choice or chooses more than one gift, the Bank will assign the RewardCash as the Welcome Gift for such Eligible Cardholder without prior notice. 9. The Laptops and the Cameras are available while stocks last. The Bank reserves the right to replace the Laptops and/or the Cameras with other items, without prior notice. In the event of overwhelming responses to the Welcome Gifts, Eligible Cardholders may experience delay in receiving the Laptop or the Camera. In such case, the Bank will notify the affected Eligible Cardholders of the relevant arrangements in the redemption letter or via the redemption enquiry hotline. 10. The observed retail prices of the Laptop and the Camera are the prices observed on the market by the suppliers. Product descriptions/images are provided by the suppliers and are for reference only. The Bank is not responsible for setting the observed retail prices or any difference between an observed retail price and an actual retail price in the market. 11. The Laptops and the Cameras cannot be converted into cash. Product descriptions and images are provided by the relevant manufacturers and/or suppliers and are for reference only. The manufacturers and/or the suppliers of the Laptops and the Cameras are solely responsible for the quality and availability of the products and services provided and/or supplied. 12. Only Eligible Cardholders whose Eligible Credit Card accounts are valid and in good standing during the entire fulfilment period will be eligible for the Welcome Gift. General 13. Any fraud and/or abuse of the Welcome Gift under this promotion or cancellation of any Eligible Credit Card within 13 months of opening of the Eligible Credit Card account will result in forfeiture of an Eligible Cardholder’s entitlement to the Welcome Gift. The Bank reserves the right to deduct an amount equivalent to the value of any Welcome Gift awarded to an Eligible Cardholder inappropriately as a result of any fraud and/or abuse directly from the cardholder's account held with the Bank without prior notice. 14. The Bank reserves the sole right to approve or decline any credit card applications, and the Bank is not obligated to provide reasons for declined applications. 15. No person other than the customer and the Bank will have any right under the Contracts (Rights of Third Parties) Ordinance to enforce or enjoy the benefit of any of the provisions of these terms and conditions. 16. In case of disputes arising out of this promotion, the decision of the Bank shall be final and conclusive. 17. The Bank reserves the right to suspend and/or terminate granting the Welcome Gifts and/or the annual fee waiver, and/or vary these terms and conditions at any time without prior notice. The Bank accepts no liability for such change or suspension/termination. 18. These terms and conditions are subject to prevailing regulatory requirements. 19. In case of discrepancies between the English and Chinese versions of these terms and conditions, the English version shall apply and prevail. 20. These terms and conditions are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (“Hong Kong”). Each of the Bank and the customer submits to the non-exclusive jurisdiction of the courts of Hong Kong but these terms and conditions may be enforced in the courts of any competent jurisdiction.
